These Terms of Use ("Terms") govern your access to and use of gimmemwah.com (the "Site"), operated by MWAH ("MWAH," "we," "us," or "our"). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility and age restriction
The Site is intended solely for adults 21 years of age or older who reside in Washington State. By accessing the Site you represent and warrant that you are at least 21 years old, that you reside in Washington State, and that you have the legal capacity to enter into these Terms. If you do not meet these requirements you must exit the Site immediately. We reserve the right to terminate access to any user we believe does not meet these requirements.
2. No direct-to-consumer sales
MWAH does not sell cannabis products directly through the Site. Cannabis products are available exclusively through licensed Washington State cannabis retailers. The Find Us directory is provided for informational purposes only to help you locate licensed retailers that may carry MWAH products. Nothing on the Site constitutes an offer to sell cannabis or an invitation to purchase. Product availability at any particular retailer is subject to change without notice; call ahead to confirm before visiting.
3. Regulatory compliance
MWAH is a Washington State licensed cannabis producer/processor. The Site and our products are regulated under Washington law, including the Uniform Controlled Substances Act (RCW 69.50) and regulations of the Washington State Liquor and Cannabis Board ("WSLCB"), including WAC 314-55-155. Nothing on the Site should be interpreted to authorize use, possession, transport, or sale of cannabis outside of Washington State or in violation of any applicable law. Cannabis remains a Schedule I controlled substance under federal law.
4. Acceptable use
You agree that you will not, and will not attempt to:
Bypass security or access controls. This includes bypassing, disabling, or circumventing the age gate; accessing the Site through any means other than the interface we provide; or attempting to probe, scan, or test the vulnerability of the Site or any associated infrastructure.
Scrape, crawl, or automate access. Except to the extent expressly permitted by our robots.txt file, you may not use any automated means (including bots, spiders, scrapers, or harvesters) to access, monitor, or copy any content from the Site. You may not copy or republish the Find Us retailer directory in whole or in part for any commercial purpose.
Interfere with operation. You may not take any action that imposes an unreasonable or disproportionately large load on our infrastructure, introduces viruses or malicious code, or otherwise interferes with the proper functioning of the Site.
Misuse content. You may not use the Site or its content in any way that is unlawful, harmful, threatening, abusive, harassing, defamatory, fraudulent, or that infringes the rights of others.
Violate law. You may not use the Site for any purpose that violates any applicable federal, state, or local law, including laws relating to cannabis, advertising, consumer protection, and intellectual property.
5. Intellectual property
All content on the Site — including text, graphics, logos, photographs, product names, product imagery, and the "MWAH" word mark and associated marks — is owned by MWAH or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may view and temporarily cache content for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without our prior written consent. All rights not expressly granted are reserved.
6. Retailer directory and third-party information
The Find Us page lists licensed Washington State cannabis retailers that may carry MWAH products. This information is provided for convenience and is sourced from our internal records, which may not reflect real-time inventory, operating hours, or licensing status. Retailer inclusion is not an endorsement of any particular retailer, nor a guarantee that the retailer currently stocks MWAH products. You are responsible for verifying information directly with the retailer before visiting.
The Site may contain links to third-party websites — including retailer websites, social media platforms, and external services. These links are provided for convenience only. We do not control and are not responsible for the content, policies, or practices of any third-party website, and inclusion of a link does not constitute endorsement.
7. Newsletter and communications
If you sign up for our newsletter, you consent to receive marketing emails from MWAH. Every marketing email includes an unsubscribe link. Unsubscribing removes you from marketing communications but does not prevent us from sending transactional or legally required messages (for example, a response to a privacy-rights request).
8. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MWAH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT — INCLUDING RETAILER LISTINGS, DELIVERY DATES, OR PRODUCT INFORMATION — IS ACCURATE, COMPLETE, OR CURRENT.
MWAH MAKES NO HEALTH, MEDICAL, OR THERAPEUTIC CLAIMS REGARDING ITS PRODUCTS. PRODUCTS ARE INTENDED FOR ADULT RECREATIONAL USE ONLY AND HAVE NOT BEEN EVALUATED BY THE U.S. FOOD AND DRUG ADMINISTRATION.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MWAH, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
10. Indemnification
You agree to defend, indemnify, and hold harmless MWAH, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
11. Governing law and venue
These Terms and any dispute arising out of or related to these Terms or your use of the Site are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Subject to Section 12, you and MWAH agree that any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction and venue in those courts.
12. Dispute resolution
Informal resolution first. Before filing a claim against MWAH, you agree to attempt to resolve the dispute informally by emailing [email protected] with a description of the claim. We will attempt to resolve the dispute informally within 60 days.
Binding arbitration. If we cannot resolve a dispute informally, you and MWAH agree that any dispute arising out of or related to these Terms or the Site will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that (a) you may assert claims in small-claims court if your claims qualify, and (b) either party may seek injunctive or other equitable relief in court to protect intellectual property rights. The arbitration will be conducted in King County, Washington, or, at your election, in your county of residence. Each party will bear its own costs, except as required by the arbitration rules or applicable law.
No class actions. You and MWAH agree that any dispute will be resolved on an individual basis only and not on a class, collective, or representative basis. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Opt-out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms, with "Arbitration Opt-Out" in the subject line and your full name in the body.
13. Termination
We may suspend or terminate your access to the Site at any time, with or without cause or notice. Upon termination, the provisions of these Terms that by their nature should survive — including intellectual property, disclaimer of warranties, limitation of liability, indemnification, governing law, and dispute resolution — will survive.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated through the Site or, if you have subscribed to our newsletter, via email. Your continued use of the Site after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.
15. Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and MWAH with respect to the Site and supersede all prior agreements, written or oral, regarding the Site.
16. Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms at any time without notice.
